Terms of Service

These terms are written in plain language. They are still a binding legal agreement, so please read them carefully.

1. Agreement to Terms

By creating an account or using AutismOS, you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, please do not use AutismOS.

These Terms are a legal agreement between you and AutismOS Inc., a British Columbia corporation (“AutismOS,” “we,” “us,” or “our”).

2. Description of Service

AutismOS is an AI-assisted care management platform for autism caregivers and self-managed autistic adults. The service includes:

  • Care Profile management — tracking medications, routines, dysregulations, triggers, interventions, milestones, and other care data
  • Solara, an AI assistant that helps you log and organize care information through natural language conversation
  • Voice input for hands-free data entry
  • A curated library of autism research
  • Calendar and scheduling tools
  • Spectrum wheel behavioral assessments
  • Dashboard for care pattern insights
AutismOS is nota medical service, healthcare provider, or medical device. It does not provide medical advice, diagnosis, or treatment. See Section 7 for important limitations.

3. Eligibility

To use AutismOS, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • If creating a Care Profile for a minor: be the parent or legal guardian of that child
  • If creating a Care Profile for an adult dependent: hold valid legal authority (such as a guardianship order or power of attorney) to manage their personal information and care records

You represent that all information you provide during registration and use of the service is accurate, current, and complete.

4. Account Registration and Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us immediately at admin@autismosapp.com if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

5. Early Access Service

AutismOS is currently offered in early access. This means:

  • The service is provided free of charge during the early access period
  • Features may change, be added, or be removed without notice
  • The service may experience downtime, bugs, or data issues
  • We may end the early access period and introduce paid plans, with reasonable notice

We will always give you at least 30 days’ notice before requiring payment. You may export your data and close your account at no cost if you choose not to continue.

Early access status does not reduce our commitment to protecting your data. We apply the same security and privacy standards regardless of pricing.

6. Care Recipient Data — Your Responsibilities

When you enter information about a care recipient (your child, dependent, or yourself), you acknowledge and agree to the following:

6.1 Accuracy

You are responsible for the accuracy of the information you provide. While Solara helps organize your input, you should always verify AI-parsed records — especially medication names, dosages, and frequencies.

6.2 Authority

You represent that you have the legal authority to collect and share the care recipient’s information with AutismOS and our service providers as described in our Privacy Policy.

6.3 Third-Party Information in Narratives

Your care narratives may mention other individuals — teachers, therapists, siblings, classmates. You should avoid including unnecessary personal details about individuals who are not the care recipient. Solara is instructed to extract and structure data only about the identified care recipient.

6.4 Joint Custody and Shared Care

If multiple caregivers share responsibility for a care recipient, you are responsible for ensuring that your use of AutismOS does not violate any court orders or custody agreements. If we receive conflicting instructions from caregivers regarding the same care recipient, we may freeze the account pending resolution.

6.5 Changes in Legal Authority

If your legal authority over a care recipient changes — for example, a child reaches the age of majority, a guardianship order is revoked, or a dependent regains capacity — you must notify us promptly. We may require updated documentation of your authority.

7. AI Features — Important Limitations

Please read this section carefully. It describes the limitations of AI-generated content and your responsibility when using AI features.

7.1 Not Medical Advice

AutismOS and Solara provide information and organizational tools, not medical advice. Nothing in the service should be interpreted as medical, therapeutic, legal, or professional advice. Always consult qualified healthcare professionals for medical decisions.

7.2 AI Accuracy

Solara uses artificial intelligence to parse your natural language descriptions into structured care records. AI is imperfect and may:

  • Misinterpret what you said
  • Record incorrect medication names, dosages, or frequencies
  • Misclassify the severity of events
  • Miss important context or nuance
  • Generate responses that contain inaccuracies

You should review all AI-parsed records before relying on them. For medication-related entries, AutismOS requires your explicit confirmation before saving.

7.3 Shared Responsibility for AI Actions

When Solara proposes an action — such as logging a medication dose or recording a dysregulation event — and you confirm it, the resulting record reflects both Solara’s interpretation and your approval. You are responsible for reviewing proposed actions before confirming them.

7.4 Research Information

Solara may reference autism research papers from our curated library. These references are for informational purposes only. Research findings may be preliminary, may not apply to your specific situation, and should never replace professional medical guidance.

8. Acceptable Use

You agree not to:

  • Use AutismOS for any unlawful purpose
  • Create Care Profiles for individuals you do not have legal authority to care for
  • Attempt to access another user’s data
  • Reverse engineer, decompile, or disassemble any part of the service
  • Use automated tools to scrape or extract data from the service
  • Introduce malware or malicious code
  • Attempt to circumvent security measures
  • Use the service in any way that could harm the care recipient or other individuals
  • Misrepresent your identity or legal authority

9. Intellectual Property

9.1 Our Intellectual Property

AutismOS, Solara, the AutismOS logo, and all software, designs, and content created by us are owned by AutismOS Inc. or our licensors. Your use of the service does not grant you any ownership rights in our intellectual property.

9.2 Your Content

You retain ownership of all information and content you provide to AutismOS — your care profiles, messages, notes, and other data. By using the service, you grant us a limited licence to store, process, display, and transmit your content solely for the purpose of providing the service to you. This licence ends when you delete your data or close your account.

We will never use your content to train AI models, for marketing purposes, or for any purpose other than providing the AutismOS service to you.

9.3 Feedback

If you provide feedback, suggestions, or ideas about the service, we may use them to improve AutismOS without obligation to compensate you.

10. Third-Party Services

AutismOS integrates with third-party services as described in our Privacy Policy. We are not responsible for the practices or availability of third-party services. Your use of features that rely on third-party services (such as voice transcription through Deepgram or AI responses through Anthropic) is subject to those providers’ terms of service in addition to these Terms.

11. Fees and Payment

AutismOS is currently free during the early access period. We intend to introduce paid plans in the future. When we do:

  • We will give you at least 30 days’ notice
  • We will offer a free tier with core functionality
  • You will have the option to export your data and close your account at no cost
  • Your existing data will not be held hostage behind a paywall

12. Disclaimer of Warranties

To the maximum extent permitted by law, the service is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The service will be uninterrupted, error-free, or secure
  • AI-generated content will be accurate, complete, or reliable
  • The service will meet your specific requirements
  • Defects will be corrected within any timeframe

This disclaimer does not affect any warranties that cannot be excluded under applicable Canadian law.

13. Limitation of Liability

To the maximum extent permitted by law:

(a) AutismOS Inc., its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from:

  • AI misinterpretation of care data
  • Reliance on AI-generated information for medical or care decisions
  • Service interruptions or data loss
  • Unauthorized access to your account due to your failure to maintain account security
  • Actions taken by third-party service providers

(b)Our total aggregate liability for all claims arising out of or related to these Terms or your use of the service shall not exceed the greater of: (i) the amount you paid us in the 12 months preceding the claim, or (ii) one hundred Canadian dollars (CAD $100).

(c) Nothing in these Terms excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability that cannot be limited or excluded under applicable Canadian law.

You acknowledge that AutismOS is a care management tool, not a medical device or healthcare service. Decisions about the care recipient’s health, medication, or treatment must always be made by qualified professionals and the caregiver — not based solely on AI-generated records.

14. Indemnification

You agree to indemnify and hold harmless AutismOS Inc. and its directors, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any third party’s rights
  • Inaccurate information you provided to the service
  • Your lack of legal authority to manage a care recipient’s information

15. Termination

15.1 By You

You may close your account at any time by contacting us at admin@autismosapp.com or through account settings. Upon account closure, we will delete your data in accordance with our Privacy Policy.

15.2 By Us

We may suspend or terminate your account if:

  • You violate these Terms
  • We are required to do so by law
  • We reasonably believe your account has been compromised
  • You have not used the service for 24 consecutive months (with 30 days’ prior notice)

15.3 Effect of Termination

Upon termination, your right to use the service ceases immediately. Sections 7, 9, 12, 13, 14, 18, and 19 survive termination.

16. Data After Termination

Before or within 90 days after account closure, you may request a complete export of your data in a machine-readable format (JSON or CSV). Before closure, this export may be downloaded through account settings. During the 90-day retention window after closure, export requests may be handled manually. After the 90-day period, your data will be permanently deleted and cannot be recovered.

17. Modifications to the Service

We may modify, suspend, or discontinue any part of the service at any time. For material changes that affect your use of the service, we will provide at least 30 days’ notice and you may export your data and close your account if you disagree.

18. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, except to the extent that mandatory consumer protection or other non-waivable laws in your home jurisdiction apply.

Subject to those mandatory laws, you and AutismOS Inc. attorn to the exclusive jurisdiction of the courts of the Province of British Columbia, sitting in Vancouver, for disputes arising from these Terms or your use of the service.

19. Dispute Resolution

Before initiating any legal proceeding, you agree to first contact us at admin@autismosapp.com and make a good-faith effort to resolve the dispute informally. We will attempt to resolve the matter within 30 days.

We do not require mandatory arbitration. You retain your right to bring claims in court and, where applicable, to participate in class proceedings. We believe that families caring for autistic individuals should not face unnecessary barriers to seeking redress.

20. General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutismOS Inc. regarding the service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
  • No waiver: Our failure to enforce any provision does not constitute a waiver of that provision.
  • Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor entity in the event of a merger, acquisition, or sale of substantially all of our assets, provided the successor assumes our obligations under these Terms and our Privacy Policy.
  • Force majeure: We are not liable for failures caused by events beyond our reasonable control.
  • Language: These Terms are drafted in English. If translated into another language, the English version prevails.
